NSPS & NESHAP Reporting

  • New Source Performance Standards (NSPS), established under 40 CFR Part 60, are date-based requirements that apply to facilities based on their construction, reconstruction, or modification dates. NSPS requirements are established according to industrial categories (e.g., chemical plants) or specific source types (e.g., storage tanks, engines, and boilers).
  • Emission standards are developed by considering the costs of implementation, potential environmental impacts, and energy requirements associated with achieving compliance.
  • National Emission Standards for Hazardous Air Pollutants (NESHAP), established under 40 CFR Parts 61 and 63, regulate hazardous air pollutants (HAPs), such as benzene, mercury, and vinyl chloride. NESHAP requirements are pollutant- and source-specific standards that apply to both new and existing sources that meet defined applicability criteria.
  • Pollutant-specific emission standards are technology-based requirements that establish Maximum Achievable Control Technology (MACT) standards for major sources and Generally Available Control Technology (GACT) standards for area sources.

Emission Monitoring System Support

  • Some permitted facilities are required to operate specialized analytical equipment, known as Continuous Emission Monitoring Systems (CEMS), to continuously measure pollutant concentrations and/or emission rates from one or more emission sources. CEMS data are used to demonstrate compliance with air emission requirements, are subject to regulatory agency review, and may be used to support enforcement actions when applicable.
  • Periodic stack testing involves collecting emissions measurements, typically at specified intervals or through instantaneous sampling, to verify compliance with permitted emission limits. When conducted as an official compliance demonstration, stack testing is often performed under regulatory agency oversight.
